Abstract

The implementation of prenatal HIV screening is a strategy that has been employed to prevent the transmission of HIV and to ensure the health of offspring. The objective of this study is to analyze the impact of HIV testing prior to marriage on marital harmony from the perspective of maqasid syari'ah. This research employed a qualitative approach with a descriptive-analytical design to explore the implementation of premarital HIV testing, its implications, and the maqasid syari’ah perspective on this policy in promoting marital harmony. Data were collected through in-depth interviews with couples who had undergone premarital HIV testing and healthcare professionals in Bandung City, as well as a literature review of academic journals, government regulations, and maqasid syari’ah references. The findings indicate that the implementation of premarital HIV testing in Bandung City has been based on adequate fundamental principles, although improvements are still needed in counseling methods, service standards, cross-sectoral integration, and supporting policies. Communication and disclosure of HIV status between partners are important factors in reducing the risk of HIV transmission and play a significant role in maintaining marital harmony. From the perspective of maqasid syari’ah, the policy is consistent with the principles of hifz al-nafs and hifz al-nasl, as it seeks to safeguard life and future generations from harm. Appropriate policies and service procedures for premarital HIV testing can reduce the risk of HIV transmission to spouses and children, thereby serving the public interest (maslahat) and contributing to the preservation of marital harmony.
